29 CFR  1926.1211(c)(2): A retrieval line must be attached to a mechanical device or fixed point outside the permit space in such a manner that rescue can begin as soon as the rescuer becomes aware that rescue is necessary. A mechanical device must be available to retrieve personnel from vertical type permit spaces more than 5 feet (1.52 meters) deep.  On or about February 15, 2023, a mechanical device (i.e. tripod) was not deployed while an employee was more than 5 feet deep inside a permit space preventing a rescue if necessary.

29 CFR  1926.1204(e)(2): Atmospheric hazards were not continuously monitored and the employer did not demonstrate that the equipment  for continuously monitoring was not commercially available.  Periodic monitoring was not used during the course of entry operations either.   On or about February 15, 2023, atmospheric hazards were not continuously monitored while an employee was working inside a manhole.  This condition exposed an employee to health hazards.
