29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids, or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) On or about February 28, 2023, at a new residential construction site located at 560 River Drive in Dickinson, ND, an employee was operating pneumatic nail guns at approximately 120 psi and was exposed to eye and face hazards from flying particles while working on a residential roof without wearing impact resistant eye or face protection.

29 CFR  1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design:  (a) On or about February 28, 2023, the employer was using a basket/platform attached to a SkyTrax Telehandler to raise and lower personnel onto the roof at heights up to eleven feet eight inches at or near 560 River Drive in Dickinson, ND, the platform extended more than two times the load center distance exposing employees to fall hazards greater than ten feet.
