29 CFR  1926.451(b)(3): Except as provided in paragraphs (b)(3)(i) and (ii) of this section, the front edge of all platforms shall not be more than 14 inches (36 cm) from the face of the work, unless guardrail systems are erected along the front edge and/or personal fall arrest systems are used in accordance with paragraph (g) of this section to protect employees from falling:  a) 40 Washington Avenue, New Square, NY:   On or about 3/6/23, an employee was exposed to a fall hazard of approximately 25 feet when working on a pump jack scaffold that did not have a guard rails along the front edge and was not using a personal fall arrest system when the front edge of the platform was approximately 20 inches from the face of the work and was exposed to a fall hazard of approximately 25 feet.   Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) 40 Washington Avenue, New Square, NY:   On or about 3/6/23, an employee working on a pump jack scaffold was not protected against  fall hazard of approximately 25 feet from the scaffold to the ground below.   Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.454(a):  The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a) 40 Washington Avenue, New Square, NY:   On or about 3/6/23, employees working on a pump jack scaffold were exposed to a fall hazard of approximately 25 feet and  did not receive training on the hazards associated with the scaffolding and procedures to control or minimize those hazards.  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19, failure to comply will result in additional penalty of $ 1,000.00

29 CFR  1926.451(c)(3):  Supported scaffold poles, legs, posts, frames, and uprights were not plumb and braced to prevent swaying and displacement  a)  40 Washington Avenue, New Square, NY:   On or about 3/6/23, employees replacing  siding on a residence worked form a pump jack scaffold that was not plumb and braced at the  bottom as required by the standard.  Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  a)  40 Washington Avenue, New Square, NY:   On or about 3/6/23, a pump jack scaffold that employees were working from to replacing  siding on a residence was not inspected by a competent person as the pump jack scaffold that was not plumb,  not braced/secured at the bottom,  the poles did not bear on base plates and mud sills or other adequate firm foundation and the walking/working surface of the metal plank was warped and had a gash/hole in it.   Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
