29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a)Texas Road House Construction Site, Fort Campbell, KY - East side of building exterior: On or about 3/7/2023, and at times prior, the employer exposed employees to struck-by and engulfment hazards associated with trenching and excavation, in that, the employer did not provide a means of egress to an employee working in a trench that was approximately six feet in depth.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.    (a) Trench - East side of building exterior: On or about 3/7/2023, workers were digging around concrete shielding water and communication lines in a six to seven foot deep trench with type C soil that was benched. The competent person did not properly evaluate soil type by classifying previously disturbed soil as type A and was using benching as the method of protection for employees.
