29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  On or about April 4, 2023, employees working in an excavation approximately 10.5 feet deep were exposed to cave-in hazards and the employer did not ensure a competent person inspected the slopes, benching, and proximity of spoil pile(s).

29 CFR  1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4):   On or about April 4, 2023, employees working in an excavation approximately 10.5 feet deep were exposed to cave-in hazards and the employer did not ensure the lower vertical wall of the excavation was four feet or less.  The lower vertical south and east walls measured approximately 7.5 feet high.

29 CFR  1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:   On or about April 4, 2023, employees working in an excavation approximately 10.5 feet deep were exposed to overhead and cave-in hazards because the employer did not ensure the spoil pile was at least two feet from the edge of the excavation.
