29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) New residential construction located on Lot #190 at 1644 Jersey Drive, McDonough, GA 30253, on top plate: On or about 03/28/2023, and at times prior, the employer exposed employee to struck-by hazards while operating pneumatic nail gun, in that protective eyewear was not provided to employees engaged in framing activities while operating these tools.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  New residential construction located on Lot #190 1644 Jersey Dr, McDonough, GA 30253, top plate: On or about 03/28/2023, the employer exposed employees to falls hazards of over 9-feet, 7-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities on the second floor of the new structure.  Armando Ramirez-Alberto was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1557471, citation number 1, item number 1, and was affirmed as a final order on 03-04-2022, with respect to a workplace located at Lot #16 Lauritsen Way, Newnan, GA 30265.
