OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed by and struck by hazards while working near the JCB 436 Wheel Loader (Serial No.: 0534530).    On or about February 22, 2023, and at times thereafter, located at the Dismantling and Processing Bays, a JCB 436 Wheel Loader (Serial Number 0534530) was used to lift and move vehicles in and out of the bays. The employer attempted a repair to the loader's control lever with the use of an epoxy. This repair failed during operation while a load was on the loader's forks exposing employees to struck-by and/or caught between hazards.

29 CFR 1910.106(b)(6):"Sources of ignition." In locations where flammable vapors may be present, precautions shall be taken to prevent ignition by eliminating or controlling sources of ignition. Sources of ignition may include open flames, lightning, smoking, cutting and welding, hot surfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat.  On or about April 5, 2023, at the facility located at 4266 Wisconsin 21, Oshkosh, Wisconsin; the employer failed to ensure that sources of ignition were kept away from flammable vapors.  Specifically, the employer failed to remove the gas from a vehicle prior to cutting the gas tank straps, resulting in a fire and exposing employees to potential thermal injuries.

On or about April 5, 2023, at the facility located at 4266 Wisconsin 21, Oshkosh, Wisconsin; the employer used a flexible cord as a substitute for fixed wiring to power two Toshiba microwaves in the break area.
