OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed by and struck by hazards while working near the JCB 436 Wheel Loader (Serial No.: 0534530).    On or about February 22, 2023, and at times thereafter, located at the Dismantling and Processing Bays, a JCB 436 Wheel Loader (Serial Number 0534530) was used to lift and move vehicles in and out of the bays. The employer attempted a repair to the loader's control lever with the use of an epoxy. This repair failed during operation while a load was on the loader's forks exposing employees to struck-by and/or caught between hazards.
