29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Building 1 Aerosol Line 1; On or about May 17, 2023, employees were exposed to continuous noise at 57.58% of the permissible daily exposure of 85 dbA (8-hour time weighted average) or equivalent sound levels of 86.0 dbA during 465 minutes sampling period. The exposure calculation included a zero increment of the 15 minutes not sampled. The employer did not implement a continuing and effective hearing conservation program for employees exposed to potential hearing loss while operating the aerosol can line.  b) Building 1 Aerosol Line 1; On or about May 17, 2023, employees were exposed to continuous noise at 57.6% of the permissible daily exposure of 85 dbA (8-hour time weighted average) or equivalent sound levels of 86.0 dbA during 444 minutes sampling period. The exposure calculation included a zero increment of the 36 minutes not sampled. The employer did not implement a continuing and effective hearing conservation program for employees exposed to potential hearing loss while operating the aerosol can line.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Mixing Room (Building 2); On or about April 12, 2023, and at times prior, the employer exposed employees to respiratory hazards, in that a medical evaluation was not provided for employees using a 3M full face respirator while mixing chemicals.   The Dixon Investments, Inc dba ARI was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 FR 1910.134(e)(1), which was contained in OSHA inspection number 1339367, citation number 2, item number 1-a and was affirmed as a final order on March 6, 2019, with respect to a workplace located at 2523 S. McDonough Road, Orchard, Hill, Georgia.
