29 CFR  1910.28(a)(1): The employer did not provide protection for each employee exposed to fall and falling object hazards:   a) Warehouse Area - On or about April 17, 2023, the employer did not ensure that all fall protection and falling object protection required by this section meet the criteria in � 1910.29, except that personal fall protection systems required by this section meet the criteria of � 1910.140.  An employee was exposed to a fall of greater than 15 feet when the employee was raised by a Toyota forklift while standing on a pallet without any means of fall protection.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) Warehouse - On April 21, 2023, the employer failed to ensure that employee(s) who operate the forklifts in the facility, were properly trained, evaluated and certified to operate it in a safe manner.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
