OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple injuries from employees falling from super sacks stacked approximately between 24 feet to 32 feet high. This was due to the fact that employees were using fall protection that was attached to the fabric handles of other super sacks without determining if the fabric handles or the super sack itself would support the employee if they fell. The employer did not verify that the fabric handles or the super sacks themselves would support 5,000 pounds if an employee should fall. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to ensure that employees have appropriate anchor points on which to attach their lanyards. a) Laydown Yard: Employees working atop a pile of super sacks containing dry cement were not tied off to a proper anchor point and were exposed to falls of up to 32 feet.

29 CFR 1910.28(b)(1)(i):29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. a) Building 241: An employee was standing atop a pile of super sacks to place the fabric handles over a forklift attachment. The employee was not protected from falls of up to 9-feet, due to him placing the lanyard at the top of the super sack he was standing on. The 6-foot lanyard would not have prevented him from hitting the floor below. ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1917.14: Cargo, pallets, or other materials stored in tiers were stored or stacked in an unstable manner. a) Laydown yard: On or about May 5, 2023 piles of Super Sacks (AKA Bulk Bags) full of dry concrete mix were stacked in several separate piles of varying lengths and heights. Each pile contained several individual bags which were visibly unstable and ready to topple over or collapse the other bags above them. ABATEMENT CERTIFICATION IS REQUIRED
