29 CFR 1915.115(a)(1): When used to transfer materials or equipment from or to a vessel, cranes which are placed onboard barges, other vessels, or on wingwalls of floating drydocks, were not tested and certified in accordance with the standards provided in 29 CFR 1919.71 (a) (3) of Hoisting and Hauling Equipment by accredited persons.    (a) Vigor Marine LLC., 5555 North Channel Avenue, Portland Oregon 97217; Shipyard dock areas, On or about 10 April 2023 and at times prior thereto, Employees were exposed to crush by/struck by hazard which would cause serious injuries, disability and death from 4-year crane certifications out of date.

OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to and/or equipment failure:  (a)Vigor shipyard dock area: On or about April 10, 2023, and at times prior thereto,; the employer exposed employees to fall hazards and equipment failure by using a suspended work platform that was not approved or certified by a registered professional engineer.
