29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  Employee(s) operating  powered industrial trucks to move materials located at 2345 U Road, Sabetha, Kansas were not all provided with forklift training, thus exposing pedestrians in the facility to struck-by hazard.

29 CFR  1910.178(q)(7):  Industrial trucks were not examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily:  Powered industrial trucks used to move materials located at 2345 U Road, Sabetha, Kansas were not inspected daily to discover equipment defects prior start of shift.  A caterpillar forklift in the West shop production department had a defective horn, thus exposing workers to struck-by hazards.

29 CFR  1910.212(a)(1):  One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  Employee(s) engaged in operating the Worth horizontal bandsaw in the West shop production department located at 2345 U Road, Sabetha, Kansas were exposed to imputation hazards.  The unused portion of the bandsaw blade was not guarded.
