The unequal weight involving three sides of formwork, metal box of taper ties and associated equipment to include inadequate rigging caused the platform to shift vertically resulting in two employees, formwork, and material to fall 40 feet to the ground. This condition exposed employees to fall and struck-by hazards.

29 CFR 1926.1431(a): The use of equipment to hoist employees is prohibited except where the employer demonstrates that the erection, use, and dismantling of conventional means of reaching the work area, such as a personnel hoist, ladder, stairway, aerial lift, elevating work platform, or scaffold, would be more hazardous, or is not possible because of the project's structural design or worksite conditions: (a)Northland Concrete and Masonry Company, LLC at 1508 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 25, 2023, the exposing employer did not prohibit employees from being hoisted on a Doka working platform that did not meet the requirements related to hoisting personnel. The employer allowed employees to be hoisted on the platform that supported formwork and miscellaneous material to be moved vertically into position for the next concrete pour. The platform shifted and tipped vertically, causing the formwork, box of ties, and employees to be pulled off the platform and fall approximately 40 feet, causing serious injury to the employees. This condition exposed employees to fall and struck-by hazards. (b)Northland Concrete and Masonry Company, LLC at 1508 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 25, 2023, the exposing employer did not prohibit employees from being hoisted on formwork scaffolding that did not meet the requirements related to hoisting personnel. Employees remained on a section of wall form scaffolding on the exterior of the north elevator core shaft, while the system was being moved vertically for the next concrete pour. This condition exposed employees to fall and struck-by hazards.
