29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident:    On or about June 14, 2023 employees were exposed to caught between hazards when the employer failed to ensure that the forklift operator was adequately retrained to safely operate the forklift after an injury had occurred.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  On May 31, 2023 at approximately 3:30 pm an employee working in a man basket that was secured to a forklift was hospitalized and had an amputation. The hospitalization and amputation were not reported within 24 hours to the local Area Offices of the Occupational Safety and Health Administration. The hospitalization and amputation were reported electronically by Serious Event Report on June 9, 2023.
