29 CFR  1910.178(l)(5): If an operator has previously received training in a topic specified in paragraph (l)(3) of this section, and such training is appropriate to the truck and working conditions encountered, additional training in that topic is not required if the operator has been evaluated and found competent to operate the truck safely.   a) On or about May 26, 2026, the employer did not evaluate the competency of operators who were permitted to operate the Stand-Up Electric Yale lift truck. The operators were not trained or evaluated in-house and the employer relied on training received from their previous employers.  b) On or about May 26, 2026, the employer did not evaluate the competency of operators who were permitted to operate the Sit-down LPG Yale lift truck. The operators were not trained or evaluated in-house and the employer relied on training received from their previous employers.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.178(q)(7): Powered industrial truck(s) which were used on a round-the-clock basis were not examined for defects after each shift:  a)  On or about May 26, 2026, the employer did not ensure that powered industrial trucks were examined daily for conditions that could adversely affect the truck's safety before being placed into service. Employees operated the Stand-Up Electric Yale lift truck to move various materials throughout the facility.   b) On or about May 26, 2026, the employer did not ensure that powered industrial trucks were examined daily for conditions that could adversely affect the truck's safety before being placed into service. Employees operated the Sit-down Yale LPG lift truck to move various materials throughout the facility.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
