29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying when hazards exist.)  (a) On or before June 21, 2023, and at times prior, as the controlling employer, Platte Capital Projects, Inc. did not ensure their subcontractors, DBS, Inc., protected their employees in that employees were exposed to cave-in hazards while waterproofing a basement foundation. The controlling employer did not maintain a safety program in that project managers, conducting daily inspections, do not have the training, experience or ability to identify workplace hazards.
