29 CFR 1910.23(c)(3): The employer did not ensure that ladders are not loaded beyond the maximum intended load.   a) Zeager Bros., Inc. - 4000 East Harrisburg Pike, Middletown, PA 17057 - On or about June 30, 2023, employees exceeded the 225-pound load capacity of a Louisville FE0616, 16-foot, portable fiberglass extension ladder while accessing the roof of a dry van trailer, and were exposed to a fall hazard of up to 13.5 feet above ground.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.23(c)(11): The employer did not ensure that portable ladders used to gain access to an upper landing surface have side rails that extend at least 3 feet (0.9 m) above the upper landing surface.  a) Zeager Bros., Inc. - 4000 East Harrisburg Pike, Middletown, PA 17057 - On or about June 30, 2023, employees were exposed to a fall of approximately 13.5 feet in height to the ground level below while using a Louisville extension ladder, that did not extend 3 feet beyond the roof of the dry van trailer.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. 29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  a) Zeager Bros., Inc. - 4000 East Harrisburg Pike, Middletown, PA 17057 - On or about June 30, 2023, the employer failed to assess the dry van trailer roof repair operations for potential hazards which would require the use of personal protective equipment. Employees were exposed to falls up to 13.5 feet above ground.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
