29 CFR 1926.416(a)(1): The employer permitted employees to work in close proximity to energized, unguarded, and ungrounded electric power circuits that the employee could contact in the course of their work: a) 1040 Hwy 35, Middletown, NJ: An employee was utilizing a Genie Lift, model Z-60, serial #Z6013-12480 in order to install electrical receptacles on the front of the building. The lift's boom made contact with a 72 KV powerline. The lift became energized, and the employee sustained an electrical shock. The employee was at a height of approximately twenty-one feet when he fell and sustained fatal injuries. Violation occurred on or about 07/11/23 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated a) 1040 Hwy 35, Middletown, NJ: An employee was utilizing a Genie Lift, model Z-60, serial #Z6013-12480 in order to install electrical receptacles on the front of the building. The employee was not attached to the basket by a lanyard. The employee was at a height of approximately twenty-one feet from the bottom of the platform to the ground. Employee sustained an electrical shock and fell from the basket, receiving fatal injuries. Violations occurred on or about 07/11/23 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. The Employee did not wear fall protection while at a height of approximately twenty one feet.
