1926.20(b)(2)  Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. 29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level.  a) On or about July 12, 2023, the employer did not do an adequate inspection of the jobsite to ensure that the guardrail system on the scaffold was secured.  Employees working on the northwest side of a commercial building were potentially exposed to a 5 story fall while laying brick from a scaffolding at 5454 Detroit Ave, Cleveland, Ohio 44102.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms.  On or about July 12, 2023, employees working on northwest side of a commercial building were exposed to a 5 story fall while laying brick from a scaffolding at 5454 Detroit Ave, Cleveland, Ohio 44102; the employer did not ensure that the guardrail systems were installed along all open sides and ends between the mast climber and supported scaffolding.  The L.M.R. Construction Co., Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1), which was contained in OSHA inspection number 1421821, citation number 1, item number 2 and was affirmed as a final order on September 17, 2019, with respect to a workplace located at 13271 Bass Lake Road, Chardon, Ohio 44024.
