29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On July 27, 2023, and at times prior, the employer does not require the use of any form of fall protection while working on the roof of a residence. This violation was most recently observed at 406 South 11th Street in Bismarck, North Dakota where employees were not protected from fall hazards of up to 25 feet while performing roofing activities. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls and that no employee is allowed onto a roof more than six feet high without adequate fall protection. (b) On July 27, 2023, and at times prior, the employer does not require the use of any form of fall protection while working on the roof of a garage. This violation was most recently observed at 406 South 11th Street in Bismarck, North Dakota where employees were not protected from fall hazards of up to 8 feet while performing roofing activities. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls and that no employee is allowed onto a roof more than six feet high without adequate fall protection. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1630818, Citation 1, Item 1, and was affirmed as a final order on February 22, 2023, with respect to a workplace located at or near 5639 Niagara Drive in Bismarck, North Dakota. (a) On July 27, 2023, and at times prior, the employer does not require the use of eye protection while using pneumatic nail guns. This violation was most recently observed at 406 South 11th Street in Bismarck, North Dakota where employees were using pneumatic nail guns to fasten shingles to a residential roof without face and eye protection where nails and shingle particles could deflect into the eyes. To abate this violation, the employer must ensure that its employees performing roofing work are protected from hazards of potential eye injury. 29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. (a) On July 27, 2023, and at times prior, the employer does not require ladders to extend three or more feet above the landing surface during roofing work. This violation was most recently observed at 406 South 11th Street in Bismarck, North Dakota where employees were using a ladder that did not extend three feet while performing roofing activities. To abate this violation, the employer must ensure that its employees performing roofing work are protected from hazards associated with the use of portable ladders and that no employee is allowed to use a ladder without ensuring it is extended three or more feet past the landing surface. This violation was most recently observed at 406 South 11th Street in Bismarck, North Dakota where employees were using a ladder that had debris piling up around and against the side of the base and positioned on an uneven surface while performing roofing activities. To abate this violation, the employer must ensure that its employees performing roofing work are protected from hazards related to using a portable ladder and that no employee is allowed to use a ladder without ensuring it is on a stable surface free from debris possibly influencing the stability.
