On or about August 18, 2023, the employer did not ensure at least every five (5) years, the process hazard analysis (PHA) was updated and revalidated, to assure that the process hazard analysis is consistent with the current process in that the PHA for the Energy Recovery Unit (ERU) Material Handling covered process was updated and revalidated on November 27, 2023, and was not within five years from completion of the previous PHA on June 16, 2018. Employees working on and in the vicinity of the covered process were thereby exposed to a process that may not be consistent with the process evaluated in the PHA which may not identify and analyze the significance of potential hazards which could result in contact with hazardous chemicals, fires, and explosions.

29 CFR 1910.119(l)(1): The employer shall establish and implement written procedures to manage changes (except for "replacements in kind") to process chemicals, technology, equipment, and procedures; and, changes to facilities that affect a covered process.   a.  Located in the Energy Recovery Unit's (ERU) East Cell Room on or about July 26, 2023, and at times prior, the employer failed to implement written procedures to manage changes (MOC) to equipment that affect a covered process in that the Drexelbrook Engineering Company conductance probe (Tag # LSH-100A) for the containment pit for the eight flammable liquid hazardous waste tanks (Identified as 1506, 1511, 1512, 1513, 1514, 1515, 1516, and 1517) which detected leaks and interlocked to the transfer feed pumps for all of the tanks, was removed from its designated location without implementing the written procedure to manage the change. Process changes were not properly managed by identifying, evaluating, and reviewing the change prior to implementation. As a result, employees working on and in the vicinity of the covered process were exposed to hazards such as, but not limited to: contact with hazardous chemicals; fire; and explosion hazards.
