29 CFR  1926.102(a)(2): The employer did not ensure that each affected employee used eye protection that provided side protection when there is a hazard from flying objects.  a) On or about August 14, 2023, employees working at 300 Carroll Street NW, in Washington DC; employees ripping the roof were not wearing eye protection provided during the process exposing them to flying objects such as nails or splitters while using hammers to remove plywood and shingles from the roof.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about August 14, 2023, employees working at 300 Carroll Street, NW in Washington DC; employees were observed performing roofing repairs they were wearing a body belt and exposed to a fall hazard of approximately 35 feet to the lower level.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about August 14, 2023, employees working at 300 Carroll Street NW, in Washington DC; employees were observed using an extension ladder with the rails flush to the roof landing exposing them to a 35 foot fall while using the ladder to access the roof.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
