29 CFR 1910.29(b)(2): The employer did not ensure that guardrail systems met the requirement that midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent intermediate members that are installed between the walking-working surface and the top edge of the guardrail system as follows when there is not a wall or parapet that is at least 21 inches (53 cm) high: On August 15, 2023, and times prior to, employees of Treasure Ice, LLC; dba Polar Station, assemble building components on a second-floor mezzanine at 3440 S. Highway W in Winfield, Missouri. The employer did not ensure the midrail was installed on the guardrail systems. Employees were exposed to fall hazards of approximately 9.5 feet above the lower level.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: On August 15, 2023, and times prior to, employees of Treasure Ice, LLC, dba: Polar Station were utilizing a forklift attachment on powered industrial trucks at 3440 S. Highway W in Winfield, Missouri. The employer did not ensure modification and additions affecting the capacity of the powered industrial truck received manufacturers approval before use. Employees utilized a telescopic jib boom attachment measuring 10.5 feet long by 2.5 feet wide to lift and position building roof sections. The employees were exposed to struck-by hazards by reducing the capacity and center of gravity of the powered industrial trucks.
