29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use.  On or about 26 October 2023, and times prior to, one employee of Treasure Ice, LLC, dba: Polar Station was applying spray polyurethane foam at 3440 S. Highway W in Winfield, Missouri while wearing a full-face respirator. At these times there was no written respiratory protection program with worksite-specific procedures.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was required to use the respirator in the workplace.  On or about 26 October 2023, and times prior to, one employee of Treasure Ice, LLC, dba: Polar Station was applying spray polyurethane foam at 3440 S. Highway W in Winfield, Missouri while wearing a full-face respirator. The employer did not ensure employees received medical evaluations before using a 3M full-face respirator, and previously a Moran full-face respirator,  exposing employees to respiratory hazards.

29 CFR 1910.134(f)(2): An employee using tight-fitting facepiece respirators was not fit tested prior to initial use of the respirator.  On or about 26 October 2023, and times prior to, one employee of Treasure Ice, LLC, dba: Polar Station was applying spray polyurethane foam at 3440 S. Highway W in Winfield, Missouri while wearing a full-face respirator. The employer did not ensure fit testing was performed for employees who wear respirators.
