29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. The employer makes no attempt to protect employees from fall hazards as observed while framing work was being done with the absence of required fall protection mitigations. This most recently occurred on August 16, 2023, at a new build residential subdivision located at 1230 Lake Forest, Lot 159, Hebron, Ohio 43205. The employer neglected to safeguard employees conducting framing work at the unprotected side and edge of the garage roof of the new build residential construction worksite. On or about August 16, 2023, the employer did not initiate and maintain an effective safety and health program to ensure hazard detection and correction of hazards while employees installed framing lumber on the garage roof of a new build residential home. The employees were exposed to a fall distance of 10 feet 4 inches to the ground level as a result. EVT Building LLC was previously cited for a repeat serious violation of this occupational safety and health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1572692, citation number 2, item number 1a and was affirmed as a final order on 30 JUNE 2022, with respect to a workplace located at Vicinity Of Lot 138, 5518 Oakhurst Drive, Hebron, OH 43025.
