29 CFR  1926.501(b)(13):  "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   The employer makes no attempt to protect employees from fall hazards as observed while framing work was being done with the absence of required fall protection mitigations.  This most recently occurred on August 16, 2023, at a new build residential subdivision located at 1230 Lake Forest, Lot 159, Hebron, Ohio 43205.  The employer neglected to safeguard employees conducting framing work at the unprotected side and edge of the garage roof of the new build residential construction worksite.  EVT Building LLC had been previously cited for a violation of this Occupational Safety and Health standard 29 CFR  1926.501(b)(13) which was contained in inspection numbers:  1)  1572692, Citation 1, Item 1, Issued on 14 April 2022 2)  1559472, Citation 2,  Item 3, Issued on 05 NOVEMBER 2021 3)  1476705, Citation 1,  Item 1, Issued on 05 JUNE 2020 3)  1475141, Citation 1,  Item 3, Issued on 26 MAY 2020  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.

29 CFR  1926.20(b)(1):  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.  On or about August 16, 2023, the employer did not initiate and maintain an effective safety and health program to ensure hazard detection and correction of hazards while employees installed framing lumber on the garage roof of a new build residential home.  The employees were exposed to a fall distance of 10 feet 4 inches to the ground level as a result.  EVT Building LLC was previously cited for a repeat serious violation of this occupational safety and health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1572692, citation number 2,  item number 1a and was affirmed as a final order on 30 JUNE 2022, with respect to a workplace located at Vicinity Of Lot 138, 5518 Oakhurst Drive, Hebron, OH 43025.  EVT Building LLC was previously cited for a repeat serious violation of this occupational safety and health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1559472, citation number 2,  item number 1 and was affirmed as a final order on 02 DECEMBER 2021, with respect to a workplace located at 3779 Mystic Way, Lot 134, Grove City, Ohio 43123.  EVT Building LLC was previously cited for a serious violation of this occupational safety and health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1475141, citation number 1, item number 1 and was affirmed as a final order on 24 JUNE 2020, with respect to a workplace located at 5203 Meadowsview Ln, Lot #50, Hilliard, Ohio 43026.

On or about July 11, 2023, the employer did not ensure that the employees used eye protection while using pneumatic nail guns while framing a residential new build house, thereby exposing the employees to struck-by hazards.  b. On or about July 11, 2023, the employer did not ensure that the employees used eye protection while using circular saws while framing a residential new build house, thereby exposing the employees to struck-by hazards.  EVT Building LLC was previously cited for a repeat serious violation of this occupational safety and health standard 29 CFR  1926.102(a)(1), which was contained in OSHA inspection number 1559472, citation number 1,  item number 1 and was affirmed as a final order on 02 DECEMBER 2021, with respect to a workplace located at 3779 Mystic Way, Lot 134, Grove City, Ohio 43123.
