OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck by and caught between/crushing hazards:   a) On or about 08/22/2023, at the site of R&L Carriers Shared Services LLC, Dock Door 12, located at 5555 River Road, Tonawanda, NY; an employee was operating a power industrial vehicle(Hyster H30 Forklift) without the use of the seatbelt when the employee reversed the forklift truck and drove backward off the dock, resulting on fatal injuries.   ABATEMENT DOCUMENTATION REQUIRED

29 CFR  1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly:  a) On or about 08/22/2023; throughout the terminal; where the computer module of the Electronic Dock Management System, EDMS device, which the employer attached to the Hyster H30 Forklift, contributed to unsafe operation (distracted driving) of the Powered Industrial Vehicle (PIV) in the facility. Employee was observed looking at, and entering data into, the computer module while operating the PIV.  Employee was exposed to crushing hazards.   ABATEMENT DOCUMENTATION REQUIRED

29 CFR  1910.178(m)(6): A safe distance was not maintained from the edge of ramps or platforms while on any elevated dock, or platform or freight car:  a) On or about 08/22/2023; at dock door 12, where a powered industrial vehicle (PIV) operator was exposed to the unprotected edge of the dock while driving the Hyster H30 forklift truck in reverse while the dock door was opened and unprotected. There was no trailer at the dock 12 and no chain, other barrier, or warning device was provided to prevent the PIV from driving off the edge of the dock. Employee was exposed to crushing hazards.  ABATEMENT DOCUMENTATION REQUIRED
