OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  Location: Jobsite- 780 West Main St, Avon, MA  On August 23, 2023, employees were exposed to fall hazards of up to 13 feet while using a ladder platform shingle hoist to access the roof. The hoist was not designed to be used in place of a ladder and was not equally supported as it rested against the gable end of the house and the materials hoist side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects  Location: Jobsite- 780 West Main St, Avon, MA  On August 23, 2023, an employee was exposed to flying particles while working on the ground picking up debris under five employees working on the roof stripping an old roof and eye protection was not utilized.

Location: Jobsite 780 West Main Street, Avon, MA  On August 23, 2023, employees were exposed to falls from heights up to 13 feet to the ground while accessing an upper landing surface where a materials hoist was used to access a commercial roof and the employees were not trained in recognizing and minimizing hazards related to working from ladders.

29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  Location: Jobsite 780 West Main Street, Avon, MA  On August 23, 2023 an employee was exposed to overhead struck-by hazards from tools and materials while working at ground level as other employees were working on the roof where protective helmets were not utilized.  Segundo Asuncion Guaman Punin DBA STP Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR  1926.100(a), which was contained in OSHA inspection number 1533824, citation number 1, item number 1 and was affirmed as a final order on July 21, 2022, with respect to a workplace located at 36 Cortland Drive, Sharon, MA.

Segundo Guaman DBA STG Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1429497, citation number 1, item number 1 and was affirmed as a final order on February 27, 2000, with respect to a workplace located at 90 Garden Drive, Manchester,  NH.
