This condition was observed on or about October 26, 2023. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. 29 CFR 1910.212(a)(3)(ii):The point of operation of machinery exposing employees to injury did not have guards that were in conformity with appropriate standards or designed and constructed to prevent employees from having any part of their body in the danger zone during operating cycles: a) Plant Floor - Cubing Machine - The employer did not effectively guard the point of operation. Employees are permitted to operate the Tiger Cubing Machine, Model CC-48, with an opening approximately 21 inches (1'-9") in width by 74 inches (6'-2") in height at the point of operation, which did not have guards designed and constructed to prevent employees from having any part of their body in the danger zone during operation, thus exposing employees to caught-in-between hazards. An employee working for the company suffered fatal injuries when he entered the energized Cubing Machine to straighten a pallet and the machine cycled thus trapping the worker between the lifting table and the upper steel plate. This condition was noted on or about August 25, 2023 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet or by a noncombustible barrier at least 5 feet high having a fire-resistance rating of at least one-half hour: a) Plant Floor - Oxygen compressed gas cylinders were not stored at least 20 feet from acetylene (fuel gas) cylinders. The employer stored four 100 pound oxygen cylinder and three 50 pound acetylene cylinders approximately 10.5 feet from each other, thus exposing employees to fire/explosion hazards. This condition was observed on or about August 31, 2023. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM.
