29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  Location: Jobsite at 818 Clay St., Manchester NH  On or about August 28 2023, the employer did not provide protection from cave-ins where employees were exposed to crushing hazards associated with cave- ins while working inside a trench that was over 5 feet deep without adequate sloping or shoring inside the trench.

A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  Location: Jobsite at 818 Clay St., Manchester NH  On or about August 28 2023, the employer did not ensure that the portable ladder being used as a means of egress from a trench over 5 feet deep was no more than 25 feet away from employees working inside the trench.
