29 CFR 1910.28(b)(11)(ii):(ii) Each flight of stairs having at least 3 treads and at least 4 risers is equipped with stair rail systems and handrails as follows: (see TABLE D-2) On or about August 22, 2023, at an establishment located at 5340 3rd Avenue in Bancroft, Wisconsin, employees of Wysocki Produce Farm were performing maintenance activities on a stairway that did not have a handrail.

At the time of initial assignment and at least annually thereafter, the employer shall instruct every employee in the safe operation and servicing of all covered equipment with which he is or will be involved, including at least the following safe operating practices: On or about August 22, 2023, at an establishment located at 5340 3rd Avenue in Bancroft, Wisconsin, employees of Wysocki Produce Farm had not received training on energy control to identify the hazards associated with applicable energy source before performing servicing and maintenance tasks on a the Air Sep potato separator.

29 CFR 1928.57(a)(6)(v): Lock out electrical power before performing maintenance or service on farmstead equipment. On or about August 22, 2023, employees were exposed to machine hazards associated with moving parts when they engaged in servicing and maintenance activities on the Spudnik Model 991 Air Sep. The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to preventative maintenance activities. The AirSep Potato Eliminator did not have the electrical power locked out prior to the employees engaging in the servicing/maintenance activity.
