29 CFR  1910.178(l)(1)(i):The employer did not ensure that each Powered Industrial Truck (PIT) operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Towers Construction, LLC at 8305 East Waterwood Circle, Sioux Falls, SD 57110: On or about and at times prior to September 6, 2023, the employer did not ensure that all PIT operators were competent to operate the Caterpillar Telehandler, Model TH360B, safely by a successful completion of a training program.  This condition exposed employees to struck-by hazards associated with improper forklift operations.

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Towers Construction, LLC at 8305 East Waterwood Circle, Sioux Falls, SD 57110: On or about and at times prior to September 6, 2023, the exposing employer employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person.  Employees were exposed to various fall hazards from the truss framing, upper levels, windows, stairwells, scaffolding hazards, ladder hazards, electrical hazards, and PIT hazards as a result of conducting residential framing activities. This condition exposed employees to a variety of fall hazards identified on site.

This condition exposed employees to fall hazards and crushing hazards associated with the platform separating from the mast of the forklift.

This condition exposed the employee to fall hazards greater than six feet.    (b)Towers Construction, LLC at 8305 East Waterwood Circle, Sioux Falls, SD 57110: On or about and at times prior to September 6, 2023, the exposing employer did not ensure that employees were protected from falls while working near unprotected windows and doorway openings on the second and third floors of a single-family residential home. This condition exposed the employee to fall hazards greater than six feet.   (c)Towers Construction, LLC at 8305 East Waterwood Circle, Sioux Falls, SD 57110: On or about and at times prior to September 6, 2023, the exposing employer did not ensure that employees were protected from falls while working near an open garage to basement stairway opening of a single-family residential home. This condition exposed the employee to fall hazards greater than six feet.   (d)Towers Construction, LLC at 8305 East Waterwood Circle, Sioux Falls, SD 57110: On or about and at times prior to September 6, 2023, the exposing employer did not ensure that employees were protected from falls while working on the second level in close proximity to an unguarded upper level and stairway access to the second level of a single-family residential home.
