29 CFR  1910.147(c)(1): Energy control program. The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment was not isolated from the energy source and rendered inoperative.   On or about September 8, 2023, the employer did not develop a lock out tag out program that included procedures for deenergizing a Morehouse Cowles V-38 -50L Industrial mixer while employees were conducting cleaning and maintenance tasks. This condition exposed employee to caught -by and struck-by hazards.

29 CFR  1910.134(c)(1):In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures:  On or about September 11, 2023, the employer did not establish and implement a respiratory protection program for employees required to use respirators when mixing chemicals for the manufacture of stucco products.  This condition exposed employees to health hazards.

29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at least included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):    On or about September 11, 2023, throughout the facility, a written hazard communication program was not implemented where employees wee using chemicals, such as, but not limited to ethylene glycol, TAMOL 945, ARCONAL 4511, and Triton X-100. This condition exposed employees to health hazards.
