OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing injuries during the process of unloading stone from shipping containers.   a. On or about September 11, 2023, Sambor Stone, Ltd., employees were not adequately protected from being struck and crushed by bundles of quartz slabs while working inside a shipping container.  Employees worked inside an enclosed container to perform unloading tasks, including removing wooden supports/bracing that secured the bundles in place and applying straps around each individual bundle to attach to a forklift for removal from the container.  During these activities, employees were exposed to struck-by and crushing hazards from the individual bundles being prepared for removal from the container, including on 12 slab bundle that had an estimated weight of more than 6100 pounds.

Facility Wide/Unloading and Receiving/Outside Remanent Storage - On or about September 11, 2023, the employer did not ensure employee(s) who operate Liquefied petroleum sit down forklifts, such as the Komatsu 45 Model: FG45BCS-7, and Komatsu 25 FG25ST-16, received an evaluation of their performance at least every three years, thereby exposing employees to struck-by hazards.

A safe place to ride shall be provided where riding of trucks is authorized.  a. On or about September 11, 2023, the employer failed to ensure that an unauthorized employee was not permitted to ride on a powered industrial vehicle. The affected employee was exposed to tip over and crush hazards while standing on the back of the Komatsu 45 Model: FG45BCS-7 forklift while another employee operated the forklift to pull a bundle of 12 quarts slabs from a closed-top shipping container.

On or about September 11, 2023, the employer failed to ensure that only stable loads were handled by forklift operators.  Affected employee(s) were exposed to crush hazards while using the Komatsu 45 LP forklift to pull bundles of 12 quartz slabs from a closed-top shipping container in a manner that caused the bundles to become unstable, thereby exposing employees to struck-by and crushing injuries.
