OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing injuries during the process of unloading stone from shipping containers. a. On or about September 11, 2023, Sambor Stone, Ltd., employees were not adequately protected from being struck and crushed by bundles of quartz slabs while working inside a shipping container. Employees worked inside an enclosed container to perform unloading tasks, including removing wooden supports/bracing that secured the bundles in place and applying straps around each individual bundle to attach to a forklift for removal from the container. During these activities, employees were exposed to struck-by and crushing hazards from the individual bundles being prepared for removal from the container, including on 12 slab bundle that had an estimated weight of more than 6100 pounds.
