29 CFR 1926.20(b)(2):  The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  Employees engaged in remodeling and restoration activities at the worksite located at 16281 Hwy 13, Jameson, Missouri were exposed to fall hazards in that the employer failed to conduct frequent and regular inspections of the job site with the purpose of identifying and correcting potential fall hazards during construction activities.

29 CFR 1926.50(c):  At this job site, the employer did not have a person who was certified in first aid training (which includes Basic First Aid and CPR) available to render first aid.  On or about September 9, 2023:  Employees engaged in restoration and remodeling activities at the worksite located at 16281 Hwy 13, Jameson, Missouri were exposed to fall hazards in that the employer did not have a person who has a valid certificate in first-aid training and is available at the worksite to render first-aid to injured employees.  The result of this failure was evident on this day when an employee fell approximately 16 feet and there was no first aid treatment available within 3-4 minutes.

29 CFR 1926.760(b)(3):  Each connector was not provided, at heights over 15 and up to 30 feet above a lower level, with a personal fall arrest system, positioning device system or fall restraint system, and did not wear the equipment necessary to be able to be tied off; or was not provided with other means of protection from fall hazards in accordance with paragraph (a)(1) of this section:  On or about September 9, 2023:  Employees engaged in remodeling and restoration activities at the worksite located at 16281 Hwy 13, Jameson, Missouri were exposed to fall hazards in that the employer did not ensure each employee working over 15 feet and below 30 feet were wearing the fall protection equipment necessary for them to safely protect themselves against fall hazards.  The result of this failure was evident on this day when an employee who did not have fall protection fell more than 15 feet suffering fatal injuries.

29 CFR 1926.761(b):  The employer did not train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program.  On or about September 9, 2023, employees engaged in remodeling and restoration activities at the worksite located at 16281 Hwy 13, Jameson, Missouri were exposed to fall hazards in that the employer failed to establish a training program on the use of fall protection equipment, the recognition of potential fall hazards and requirement for fall protection use as it relates to removing and replacing metal roof panels.  The result of this failure was evident on this day when an employee who did not have fall protection fell more than 15 feet suffering fatal injuries.

Employees engaged in remodeling and restoration activities at the worksite located at 16281 Hwy 13, Jameson, Missouri were exposed to fall hazards in that the employer failed to ensure the employees accessing and egressing the upper level of a structure extended the portable ladder at least 3 feet above the upper landing surface.
