29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)DHD Construction, Inc. dba Wall Building Center at 19775 223rd Street, Quinn, SD 57775:  On or about and at times prior to September 13, 2023, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Employees were exposed to fall hazards from the roof of the structure, fall hazards while utilizing aerial lifts, and a lack of training as a result of conducting commercial roofing activities. This condition exposed employees to a variety of hazards identified on site.

Employees were operating the lift and were not utilizing a personal fall arrest system.  This condition exposed the employees to fall and ejection hazards while working from the lift.
