OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards. Location: Jobsite On or about October 24, 2023, a worker fell approximately 25 feet from a tree when the climbing line was cut and the secondary tie-in line was ineffective causing the worker to fall from the tree to the ground below.

29 CFR 1910.140(c)(20): The employer did not ensure that ropes, belts, lanyards, lifelines, and harnesses used for personal fall protection are protected from being cut, abraded, melted, or otherwise damaged. Location: Jobsite On or about October 24, 2023, a worker was exposed to a fall from heights of approximately 25 feet to the ground below when the worker cut the climbing line with the chainsaw.
