29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:   On or about October 11, 2023, at 8617 Clinton Road, Brooklyn, OH 44114, the employer failed to ensure employees operating a Hyster 40, propane forklift, model number H40FTS, serial number F001V04287K, were retrained every three [3] years prior to allowing them to operate. Employees move product in and around the facility to include loading/unloading trucks.

29 CFR  1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  On or about January 29, 2024 at 8617 Clinton Road, Brooklyn, OH 44114, the employer failed to ensure employees utilizing N95 Filtering Face-piece respirator were trained on basic advisory information prior to being allowed to wear. Employees utilize the N95 Filtering Face-piece respirator on various jobs throughout the facility.
