29 CFR  1926.1427(a): The employer must ensure that each operator is trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section.  On or about October 16, 2023, at an establishment located at 66 North Brooke Street in Fond du Lac, Wisconsin, an employee of Whealon Towing & Service, Inc. was operating a crane and was not a certified crane operator exposing the construction crew to struck by hazards while setting trusses.
