29 CFR  1926.451(e)(5)(iii): A ramp or a walkway was steeper than one (1) vertical in eight (8) horizontal, and did not have cleats not more than fourteen (14) inches (35 cm) apart which were securely fastened to the planks to provide footing.   a- 37 Wiggins Street, Princeton NJ: On or about 10/19/23 a wooden ramp, workers and its worksite Foreman used to gain access to a residential structure's first floor, was steeper than 1 vertical and eight horizontal and did not have cleats.  As such these worker and the worksite Foreman were exposed to fall hazards.

29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   a- 37 Higgins Street, Princeton NJ: On or about 10/19/23 a company worksite worker was exposed to fall hazards, in excess of  25 feet to the ground surface below, when working from a job made supported scaffold that was set at the unprotected edges of a residential structure's third floor.  The scaffold was not supplied with guardrails and this exposed worker was not supplied with an alternate form of fall protection.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a- 37 Wiggins Street, Princeton NJ: On or about 10/19/23 the company worksite Foreman was not protected from falling when walking and working from the top plates of a residential structure's interior wall frames while not using fall protection.  As such, they were exposed to fall hazards up to and in excess of 8 feet to the flooring below.   b- 37 Wiggins Street, Princeton NJ: On or about 10/19/23 a worker was not protected from falling when walking and working next to and near unprotected edges of a residential structure's third story floor.  As such, this worker was exposed to fall hazards up to and in excess of 25 feet to the flooring below.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)    a - 37 Wiggins Street, Princeton NJ: The company worksite Foreman and their workers who were performing framing work and other related activities while walking and working from the top plates of a residential structure's inner wall frames and at and near unprotected floor edges were not trained on fall protection means and methods as specified in 29 CFR 1926.503 (a)(2)(i) through (viii). These workers were exposed to fall hazards, up to and in excess of 25 feet, while not using fall protection at the worksite. Condition noted on or about 10/19/23.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
