29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  Outside the driveway entrance to Baltej Pavilion: Employees chipping the dry concrete sidewalk with handheld powered chipping tools were not using engineering methods and work practices to control the dust created.  Employees were exposed to respirable crystalline silica.

29 CFR 1926.1153(e)(1): Where respiratory protection was required by this section, the employer did not provide each employee an appropriate respirator that complied with the requirements of this paragraph and 29 CFR 1910.134:   Outside the driveway entrance to Baltej Pavilion: Employees chipping the dry concrete sidewalk with handheld powered chipping tools were not using respiratory protection required by Table 1. Employees were exposed to respirable crystalline silica.

29 CFR  1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  Outdoors on front sidewalk: There was an exceptionally long extension cord used to provide power from a gasoline powered generator to two rotary hammers.  Employees were exposed to electrical and fire hazards.
