29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a)Mehlberg Construction at 206 Ellison Court, Lead, SD 57754: On or about and at times prior to October 25, 2023, the employer did not ensure that employees were trained to recognize and avoid unsafe conditions while conducting work on construction sites. This condition exposed employees to various hazards associated with excavation work and construction activities.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)Mehlberg Construction at 206 Ellison Court, Lead, SD 57754: On or about and at times prior to October 25, 2023, the exposing employer did not ensure that employees conducting cement foundation removal operations within an unprotected excavation greater than five feet in depth were adequately protected from trench wall cave-in by an adequate protective system. This condition exposed employees to struck-by and cave-in hazards associated with a trench wall collapse.
