29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a. At the facility: On or about September 7, 2023, the employer exposed employees to a physiological burden and inhalation hazards, in that the employer required employees to wear NIOSH approved, N95 filtering facepiece (dust mask) respirators, without first determining the employee's ability to use a respirator, while working with COVID patients.
