On or about November 15, 2023, employees engaged in residential construction activities did not have any type of fall protection. This condition exposed employees to fall hazard from 6 feet and over to the ground.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.   On or about November 15, 2023, a multi-purpose ladder did not extend at least 3 feet above the upper landing surface.  This condition exposed employees to fall hazards 6 feet or more above the ground.  Edgar Ivan Herrera was previously cited for a violation of this occupational safety and health standard 1926.1053(b)(1), which was contained in OSHA inspection number 1589446, citation number 01, item number 02 and was affirmed as a final order on 08/22/2022, with respect to a workplace located at 975 Lomaland Dr., EL Paso, TX 79907.
