29 CFR  1926.1101(k)(2)(i): Before work subject to this standard is begun, building and facility owners shall determine the presence, location, and quantity of ACM and/or PACM at the work site pursuant to paragraph (k)(1) of this section.  a.  On or about October 13, 2023, at the above addressed jobsite, the building owner failed to determine the presence, location and quantity of ACM and/or PACM prior to arranging clean up and construction activities at the location.   Individuals performing work at the location were exposed to cancer and lung effects during removal of thermal system insulation (TSI) which contained 15-20% Chrysotile Asbestos.

29 CFR  1926.1101(k)(2)(ii): Building and/or facility owners shall notify the following persons of the presence, location and quantity of ACM or PACM, at the work sites in their buildings and facilities. Notification either shall be in writing, or shall consist of a personal communication between the owner and the person to whom notification must be given or their authorized representatives:   a.  On or about October 13, 2023, at the above addressed jobsite, contractor employees were conducting clean up and manual demolition of structures in a residential building which contained PACM and/or ACM thermal system insulation.   The building owner failed to notify individuals conducting the aforementioned tasks of the presence of ACM and/or PACM, thereby exposing contractors to cancer and lung effects from ACM material containing 15-20% chrysotile.
