29 CFR  1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:  a. At a worksite located at 2309 Somerset Road, Jacksonville, FL 32210: On or about December 13, 2023, the employer exposed employees to eye injury hazards, in that eye protection was not utilized by employees who were operating pneumatic nail guns to nail down roof shingles and while using a saw to cut wood.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access:  a. Front of home located at 2309 Somerset Road, Jacksonville, FL 32210: On or about December 13, 2023, the employer exposed employees to fall hazards in that, the ladder used to gain access to the roof, the side rails did not extend three feet above the roof, exposing employees to a 10 feet fall hazard.

29 CFR  1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section:   a. On a 4:12 pitch roof, at a worksite located at 2309 Somerset Road, Jacksonville, Florida 32210:  On or about December 13, 2023 the employer exposed six employees to fall hazards, in that, fall protection was not utilized by employees while nailing down roof shingles.  The employees were exposed to the hazard of falls ranging from 10 feet to 20-foot to the ground.  Empire Roofing Sales and Service, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1407053, citation number 01, item number 001 and was affirmed as a final order on December 27, 2019, with respect to a workplace located at 2309 Somerset Road, Jacksonville, FL 32210.
