29 CFR 1910.212(a)(2): General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself. a)Wellsaw Band Saw (Model Number 0016 Serial Number: 2194); On or about December 13, 2023, and times prior, the employer exposed employees to caught in and amputation hazards, in that the employer did enforce the utilization of the adjustable machine guard, when employees cut pipes for ladder manufacturing. b) Drake Johnson Band Saw (Serial 1351496); On or about December 13, 2023, and times prior, the employer exposed employees to caught in and amputation hazards, in that the employer did not provide employees with an operating machine guard that protects employees when cutting pipes for ladder manufacturing. c) YLM (Moel CR-A389A Serial: 141219); On or about December 13, 2023, and times prior, the employer exposed employees to caught in and amputation hazards, in that the employer did not provide employees with a machine guard that protects employees when bending pipes for ladder manufacturing.

29 CFR 1910.212(a)(3)(ii):The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. a) Notcher; On or about December 13, 2023, and times prior, the employer exposed employees to caught in and amputations hazards, in that the employer did not provide employees with a guard that protects employees from the point of operation when notching pipes during ladder manufacturing.
