On or about November 27, 2023, the employer failed to develop and maintain a written Hazard Communication (HAZCOM) program for employees that clean up paint spills. Employees assigned to clean up paint spills are exposed to different chemical products including but not limited to JT501 General Purpose Solvent and Instazorb, which contains the chemical products toluene, methanol, acetone, and amorphous alumina silicate. The program must include how to train employees on how to handle hazardous chemical products during different paint spills and how to identify hazards related to the paint and chemical products used to clean up the spills including solvents, which can cause serious eye irritation and organ damage through physical contact through the skin or eyes or inhalation of the product vapors or dusts.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about November 27, 2023, the employer did not develop and implement a written training program or employee documentation for employees who conduct cleanup operations in the facility, including paint that spilled on the floor. Products used to clean spills include but are not limited to Instazorb and JT501 General Purpose Solvent. These products contain the chemicals toluene, methanol, acetone and amorphous alumina silicate. These chemicals can cause serious eye irritation and organ damage through physical contact through the skin or eyes or depression of the central nervous system or respiratory irritation when inhaling the product.

29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard")  On or about November 27, 2023, the employer did not provide employees Appendix D of 29 CFR 1910.134 Respiratory Protection Standard for the voluntary use of respirators when cleaning up paint spills inside of the warehouse. Employees assigned to be on the paint spill cleanup team were given the option to wear 3M N95 and 3M N100 Particulate Respirators when cleaning up paint spills. Employees cleaning up paint spills were using products including but not limited to JT501 General Purpose Solvent and Instazorb which contain hazardous chemicals including but not limited to toluene, methanol, acetone, and amorphous alumina silicate which can cause irritation to the respiratory and nervous system.
