29 CFR  1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  (a)Mauricio Salazar Avelan at 1103 North Splitrock Boulevard, Brandon, SD 57005:  On or about and at times prior to July  24, 2023, the exposing employer did not ensure that employees that were performing roofing work on a 4/12 pitch commercial property were protected from falls.  This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  (a)Mauricio Salazar Avelan at 1103 North Splitrock Boulevard, Brandon, SD 57005: On or about and at times prior to July 24, 2023, the exposing employer did not ensure a written training certification on the use of fall protection systems prior to employees being exposed to fall hazards while conducting roofing operations on a commercial property. This condition exposed employees to fall hazards greater than six feet.
