29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about January 9, 2024, an employee of a subcontractor under the control of the General Contractor performed work on the upper level of the awning greater than six (6) feet above the lower level without fall protection.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface, and the ladder's length allowed, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.   On or about January 9, 2024, an employee of a subcontractor under the control of the General Contractor an employee used extension ladders to gain access to the awning roof, and the side rails of the extension ladder did not extend at least three (3) feet above the landing.
