29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) On or about January 25, 2024, as the exposing employer, Laird & Son Services LLC, did not ensure that a daily inspection of the trench was conducted prior to employees working inside a trench, in that employees worked inside a trench that had 8 foot near-vertical walls, signs of sloughing, and undercutting where the pipe was being installed. This condition exposed employees to cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): a) On or about January 25, 2024, as the exposing employer, Laird & Son Services LLC, did not ensure that employees were protected from cave-in hazards while working in a trench without adequate protective systems in place. Employees were working in a trench that had 8 foot near-vertical walls, signs of sloughing, and undercutting where the pipe was being installed. This condition exposed employees to cave-in hazards.
